Ebay winning bid on 2009 Kookaburras cancelled by buyer

I won 80 2009 kookaburras last night and then the seller cancelled the sale because someone made a better offer after the auction had ended. Any way to force the sale through. If not, how do I get the seller banned from ebay?

Edit to say seller cancelled instead of buyer. Shows you how angry I was when I posted the original message.
 
I have reported the seller to ebay. I refused the cancellation by the seller. I told ebay that I want either the sale to be completed or the seller to be permanently banned. If not, then I am withdrawing from ebay.
 
Good on ya dccpa, hate dodgy buyers and sellers alike. Worst still eBay actively protects these bastards!!!

You can take legal action through the courts in Austalia. There was a case a few years back where the courts upheld an ebay auction for an aircraft that went really cheaply and the seller refused to honor the deal.

It wasn't ended early. The seller is trying to cancel the transaction after the auction is over. I had already received the winning bid notification from ebay.
 
no payment has been finalized, so each party still can refused to performed.
unless you have made the payment, then its the seller at fault?
 
AFAIK the contract is formed upon finalization of the auction. You are then required to perform your part of the bargain, ie pay. The seller is then required to perform their side and deliver the coins.

So I would suggest that there is a contract in existence right now. I'd pay the money via credit card or paypal (so you can get refund if he doesnt deliver coins) and then tell seller and advise want contract fulfilled and coins delivered asap or you will sue for breach of contract

I am planning on paying later this afternoon through paypal with a credit card.

Some of the comments appear to relate to a seller ending early - which they can do without giving a real reason but you state you won the auction and it closed. You should have received an email from e-Bay confirming success.

I got a similar thing recently where I was the winner but in an email from e-Bay I was advised a higher bidder had withdraw ( an absolutely silly bid ) and I then lost the auction on a few cents difference when out of the blue another bidder appeared. This was 10% only of the required increment so really puzzled. Challenged e-Bay but nothing !

This ebay seller is not very smart. He has already relisted the coins that he stated he sold to someone else. I reported him again, sent ebay the 2nd listing information and paid through paypal with a credit card. We shall see if ebay does anything.
 
Why are you guys so forceful about this, just leave the guy bad rep and move on. That is how to use ebay.

You're sending money to someone who doesn't want your money, this is ridiculous.

I am forcing the issue. I don't have any risk as my credit card company has always backed me up on anything. The seller was really foolish to immediately relist the coins while also claiming that they had been sold. And you can't leave bad feedback if the transaction gets cancelled. By paying, I should be able to leave feedback. And I want to see what ebay does. If they don't make the seller either complete the transaction or ban him permanently, then I know there is no reason to do further business with ebay.
 
Agree with 2ds,they are his coins(and please no one get all technical with me about the rules of an auction)
So why would you want to force this issue..just move on and put it down to the uncertainties of dealing with e-bay
If your waiting for ebay to back you up don't hold your breathseems no one is home anymore in their complaints department.
Try making a counter offer maybe he will accept something close to what you paid..
Don't forget he could have just put in a dummy bid as well.so in a way he is one of the more honest sellers.
