Over it, and filling out papers and flicking email after email back to this useless company. I really want to just drag the idiots through the courts over principal even if it costs me. I could probably represent myself and win, anyone with half a brain can read and interpret the Regulation Act in regards to precious metals. I also don't see where the ATO says i need to be a licenced dealer, don't THEY (supplier) have to be one?

If the ASEs/Maples are legal tender, they're worth $1 each.

Did you import more than 1000 of them?

Then they're GST free.

If the above statement is correct than FedEx should lose their Custom Broker licence

What can be done here en masse to make some small difference to this issue?
 
Boycotting them is easier than getting them to change their stupid ways. Just get the word out there so nobody else gets screwed.

Start a facebook page and have us "sign" an electronic petition a lot of companies comb the net for bad press in social media these days so whilst they probably wouldn't change policy etc. they would likely make a good will payment to make it go away.

Otherwise known as being a big enough pain in the arse that they cave.

In this case, they are. Either:

(a) They are legal tender coins, in which case their value is USD$1 / CAD$1 and you can bring in a lot under the $1000 limit,

or

(b) They are 999 investment grade bullion, in which case there is no GST payable on them regardless of their value.


Pick one.

Dude, I feel for you. That is so shit and bollocks. I have never bought bullion aside from a f2f transaction and this just reinforces me not to trust ANY third party with handling it. Best from the dealers hands to mine with no middle man. I really hope you get it back. just to throw an idea out there what would happen if you tried contacting today tonight or a current affair? I would be interested to see if they would even run the story, or be shunned for a precious metal piece..

Basically what it comes down to is understanding the difference between the following:

Section 38-385 - GST-free if you're a dealer
Section 40-100 - input-taxed

They're ignoring 40-100. GST-free and input-taxed are two very different things.

What about a small claims action? That would cost about $35 here in Sydney (not sure where you are but there must be a similar avenue). Quick and easy but you run the risk of getting a moron member hearing your case.

Just get an ATO court ruling and Scammex will refund your "GST"... it's just annoying and cumbersome, why bother when you can do legit business with UPS quick and easy!?

took me 3 weeks to get a favourable ruling, i copied the majority of the text for my ruling application from a thread on here somewhere and just changed the details a tiny bit.

once you have a ruling you can get as many imports as you like as long as it's the same product and they won't charge you.

took me 3 weeks to get a favourable ruling, i copied the majority of the text for my ruling application from a thread on here somewhere and just changed the details a tiny bit.

once you have a ruling you can get as many imports as you like as long as it's the same product and they won't charge you.

I'm currently in the same predicament as damien. Spoke to a Fedex customs broker who was a nice enough fellow but very clearly toeing the company line. He suggested...encouraged actually that I apply for a ATO private ruling and claim the GST paid back from them. He's obviously seen this scenario play out many times.

what was Renovator's point? he hasn't posted in this thread.

I'm just saying if they've already stolen your money, then most definitely get a private ruling and demand a refund, thenceforth, boycott the evil bastards, a point that i have made several times.

if you have already paid GST on bullion then make sure you go to the effort of getting your money back, we buy PM to prevent the govt stealing our wealth in the first place.

if anyone needs a hand, message me and i'll give you a copy of the application i used minus my personal details to use as a template.

Renovator's point was just a reference I made in a post up the page a bit just after the discussion started again - he started a thread about doing something about stuff rather than just commenting on it. It would be nice to see if something can't be done to make it so that there is achange in the way Fedex operates in dealing with this matter.

Of course, personal ATO rulings should be obtained to get funds back. I'm sure your offer of help will be appreciated.
 
I have bought in more than 100k's worth from the US in various size allotments during the past 6 months, coins and bars from a mint, they ship the with UPS and I have never had a problem, just arrives via courier. Obviously in the ATO and Customs the left handS don't know what the right hands are doing. Ain't that a big surprise.
