Shocking. The seller has more than 35.000 positive feedbacks and he is listed as "experienced seller"

Ebay accounts can be bought...

E.g. That Chinese coin dealer who used to be on here, got banned due to abusing other members. His ebay account was used to sell cosmetics... I'm pretty certain it was purchased from someone else.
 
He isn't doing anything wrong by ebay, he isn't selling them as bullion so I don't see the problem ok maybe they are illegal in the sense that they should not have denomination but do you report all your bullion to authorities? Or do you keep all purchases under 5000.... Don't be a brown noser mate

It aint brown nosing.
The problem is 2 fold.
1: It is illegal here to make imitation currency/coins which may be construed as legitimate.
2: While this person has stated they are plated someone will almost certainly buy them to on sell as "genuine coins" and some newbie WILL BUY these fake coins thinking they are real.
I would imaging there is a copyright issue with the portrait of QE11 as well.
All up these are just bad news and asking to rip off inexperienced buyers.

What the fk are you on about? Where does the brown nose come into it?
It's about making sure that the coins that we buy are legitimate and not fake.

Crimes (Currency) Act 1981 said:
9 Possessing counterfeit money or counterfeit securities
(1) A person shall not:
(a) have in his or her possession counterfeit money (not being an excepted counterfeit coin), knowing it to be counterfeit money; or
(b) have in his or her possession a counterfeit prescribed security, knowing it to be a counterfeit prescribed security.
(1A) Subsection (1) does not apply if the person has a reasonable excuse.

(2) It is a defence to a prosecution of a person for an offence against subsection (1) in relation to the possession of counterfeit money or a counterfeit prescribed security if the person charged establishes to the satisfaction of the court:
(a) that he or she did not make the counterfeit money or counterfeit prescribed security; and
(b) that he or she did not, after the time when he or she first learned that the counterfeit money or counterfeit prescribed security was counterfeit money or a counterfeit prescribed security or the time when he or she acquired the counterfeit money or counterfeit prescribed security, whichever was the later time, have a reasonable opportunity to surrender it to a member of the Australian Federal Police or of the police force of a State or Territory or to any other person prescribed for the purposes of this section.
(3) A person shall not, with intent to defraud, have in the possession of the person an excepted counterfeit coin, knowing it to be counterfeit money.
Penalty:
(a) in the case of a person, not being a body corporateimprisonment for 10 years; or
(b) in the case of a person, being a body corporate$50,000.

A member on the forum has been down this road before - the legislation is pretty clear on this, and advice from the AFP at the time was that the "reasonable excuse" exception could only be determined by a court - I.e. if you were caught with a fake for "comparative use", they would still charge you and let the courts work out if you would be allowed to keep it for the purported use. Hence the "evidential burden" bit.

Subsection 3 would apply to anyone buying a fake from eBay and then passing it off as real currency. $50k fine and 10 years of contemplation.
 
This kind of stuff make me boil I reported that seller to ebay over a week ago, total waste of time I've reported sellers of this kind of crap before and nothing happens. Ebay don't have the courtesy to come back to you to say what is happening.

About a year ago I also reported some other idiot selling Perth Mint fakes on ebay to the Perth Mint. They did respond to me and thanked me for bringing it to their attention etc.

I think Perth Mint should get their act together and have someone specifically employed to take tough action on this kind of thing. Involve the police etc & threaten ebay as well as they are the main conduit for where this shit is being sold.

It's a flood from China and if eBay can't be bothered to do anything then it's likely the police won't bother either.
