[Advice] 2006 10Y Panda MS70 - white spots and toning

Need some advice from some wiser Panda collectors. Just received this coin bought from fleebay. It is claimed to be conserved by NCS and graded MS70 by NGC and was advertised as in mint condition. I did email the seller prior to bidding to check the condition and this was the reply.

About the 2006 panda can please confirm the condition of the coin. Any spots , markings or toning? What is the current price for this ?
Shipping to Australia is that ok

Coin is in perfect condition. No toning no white spots. Shipping to Australia should be about $15-$20.

On inspection of the coin both naked and under magnification I could see two white spots(?milk spots). Less obvious on the rim of the coin circled is a slight shift towards a red tone. Am I being to fussy too expect these changes not be present on a MS70 coin. Everything about sale has gone perfectly thus far and the seller is apparently a forum leader in another coin forum so I want to get my facts right before I email the seller.

I agree with Fish... the toning is fine (and sometimes seen as desireable)... the whitespots are not.

Does the NGC number start with a "3"?
 
if the seller said to you upon inquiry no white spots ,he should either refund or replace for you.........
 
Was on the phone before so couldn't type a lengthy detailed response.

I believe as a buyer you should exercise your right to a refund because:

1. You can
2. White spots affect value greatly in the long run, unlike toning or slight white hazing.
3. You can most likely get a non-white spotted coin at the same/similar price, so why not try?

First you should talk with the seller and ask him for an exchange or refund.

If he agrees then that's good. If not then you can go to Paypal and lodge an "item not as described" complaint and say the coin has white spots contrary to his listing.

That should get your money back.
 
if I were you, will take out the hammer and hit it open, send the case back to ngc with a note and return the coin to the seller with a note, panda spots or the spots will be on you seller!

Thanks everyone for the replies. I wrote to the seller and he has offered

1. Return coin and full refund
2. Keep the coin and partial refund of $200

Coin was purchased for around $440 all up.

Does the NGC/NCC guarantee cover this sort of issue?
 
That sounds pretty fair ............ if you like the coin and can live with those small spots, take a shot at the guarantee you could wind up with a free coin
 
Thank you everyone for the advice here and PMs. I took up the offer of the partial refund. Will email NGC and see what the process to get the coin reassessed.

Sounds like an inadvertent genuine error on the sellers part. He was quick to offer a refund and apology so it is probably a win-win situation for both.
