IT WAS the dead of night and security provider David McNamara was alone heading south on the Bruce Highway with a valuable cargo of gold bullion, when suddenly he was hit by blinding lights from behind.

Fearing for his life, Mr McNamara hit the accelerator and was caught on a speed camera doing 142km/h.

Mr McNamara's dramatic tale of "an extraordinary sequence of events" on that night in May 2011 convinced a Gladstone magistrate last year that he should be spared a $933 fine.

But it was not enough for him to escape a conviction being recorded, which triggered a six-month disqualification of his driver's licence. He then appealed.

Mr McNamara said he was carrying 90 ounces of gold bullion, valued at $126,000, from Townsville to the Gold Coast one night in May 2011, when he encountered "a life-threatening situation".

He told the court how suddenly another vehicle came up closely behind him with its headlights on full beam and spotlights illuminated for a considerable distance.

"His vehicle was flooded with light and he was effectively blinded," Townsville District Court judge Stuart Durward said in an appeal decision.

Mr McNamara said he tried slowing down and making space for the other vehicle to overtake, before speeding up to put some distance between them.

It was then he was caught doing 42km/h over the limit at Tannum Sands, between Miriam Vale and Gin Gin.

"He was in fear of personal risk to his health because of the remote location at night-time on the highway, his not knowing the identity of, or number of the occupants of the other vehicle, his valuable cargo and the close proximity of the pursuing vehicle," Judge Durward said.

However, Judge Durward dismissed his appeal after hearing of Mr McNamara's "unimpressive traffic record", with many previous disqualifications since 1982.

"Unimpressive traffic record" is code for a serial speeder, drink driver and/or dangerous driver.
You'd be surprised how many of these people go through court on a daily basis armed with their obligatory character references which explain what a great guy he is in the community - only problem is he gets in his car every Saturday night pissed up to his eyeballs (as an example). But that's just a minor character flaw.

The judge disqualified him not because he wasn't a stacker, but because this guy is a menace on the roads.
I honestly believe some people are so consistently stupid with their driving records that they should be banned for life.
