    If the Govt wants silver and gold, it the MSM, police force, army and judicial system.

    1) The Govt can demand that are handed in.
    2) Anyone caught trading PMs gets fined and goes to jail.
    3) Citizens get rewarded handsomely for notifying their beloved authorities about people holding/trading PMs.

    Happens all the time when Main Roads RTA VicRoads etc want to make Traveston Dam, East/West Link, whatever...

    We're resuming your land at 'our' calculated valuation of 'y', even though the real market says it's worth 'y' x 2.
    The difference between their price and the market price is essentially stealing.

    The kickback came for the Qld Govt. when the Traveston dam was cancelled and the state had to sell their ill-gotten land at real market prices... you can't make people buy land (yet).

    Have one client going through the comdenation process right now and another one that did last year, both for bypasses. Know what you are doing and you will be compensated well. You can't stop a governmental entity from taking your property, but you can get full market value.

    51 (xxxi) has been tested in the High Court multiple times, it has ALWAYS been upheld.

    There is something missing from the example above, as the government 'valuation' is one of the challenges made and tested. It all gets back to the words "just terms" and the High Court has always leaned our way.

    Back when I was but a lad, the leaders here looked around the world for guidance in the framing of our new Constitution. Britain and the USA were the main ones most respected.

    The US is where our 'confiscation' Section came from. plus a few others.

    Pity we did not for some crazy reason, copy your 1st and 2nd Amendments.

    Even if they don't resume your property, you can also get stiffed when someone puts an overpass, HT power lines etc over your house or sewerage lines, transport tunnels etc under your property.

    There's such a thing as 'volumetric title'. When you buy a property, it extends above you to the heavens and below you to the centre of the earth (that excludes to some degree mineral and energy resources). If the crown interferes with that, you're entitled to some degree of compensation due to loss of amenity.

    In some parts of the world, that compensation has been limited to installing airconditioning for those that can't open their windows in summer because of the noise from the overhead expressway.

    This may well have changed, but back in the olden days Torrens Title extended down to 50'. Below that the rich gold vein belongs to "The Crown'. The air above is a bit vague as planes fly over private property all the time.

    Not really; Brisbane Airport Corporation owns an air corridor over the gateway bridge which is why (together with safety regs) the bridge couldn't go higher. It's also why people living next to NEW airports get compensated (it's not just for noise amenity).

    In large cities like NYC, Tokyo, Shanghi, there are limits to skyscraper height. Developers are able to by-pass this by 'purchasing' the volumetric title above surrounding buildings that don't use their full height allowance... and stack that onto their own skyscraper. The rub is, any future buildings on those other sites can never go any higher than the existing structure.
    That's why you have those little churches amongst the towering skyscrapers in NYC
