eBay disaster PLEASE HELP!

    Really sucks to see these scammers win & good sellers like yourself get screwed over :/
    Hopefully you can strong arm Paypal into reversing their decision!

    Consumer Affairs will work to PP as they're operating in AU, cause they're the one favoring a conman from overseas not protecting AU individuals... just open a case in CA and call back on PP that you have opened a CA case for this case... this way PP will re-investigate your case and this time will be proper with escalation due your CA open case...

    I am shocked that paypal would award against you...especially when ebay had found in your favour
    and you obvously provided evidence as such and the email you got from that bayareararecoins...

    Do you know whether paypal has processed the refund to the buyer...or are they holding the funds in escrow?

    Did they take the whole amount of the refund out of your credit card? or part of it

    So you did withdraw the circa $5k from your paypal account, obviously you did or they
    would not have debited your credit card...did they ask you not to withdraw the funds?

    Tell them again that this is a scam...and ask them not to refund the buyer, but hold the funds in escrow
    until you get your original coin back, or ask paypal to get the buyer to post the coin to the offices of paypal australia
    and you will organise its pick up if and when it is back in australia

    Let them know that this is a significant amount to you and you will seek legal advice if you are out
    of pocket because of paypals actions

    Did ebay actually say that the buyer was fraudulent...or what actually did they say when they decided on the case

    What did paypal say when they found in the buyers favour...how was it worded

    It is very hard to sell on ebay without a paypal account...you can still buy using a CC, but you wont
    get buyer protection...basically you need paypal account to use ebay

    Have you contacted your CC provider and asked their advice...have you contacted the banking ombidsman and
    are paypal disputes covered by them...have you looked into specialist lawyers...this site may help

    Have paypal said how or if they will protect you if the buyer does the same thing as he did to bayareararecoins

    We know the buyer is not going to return the same coin if he returns anything at all...because that coin
    is now worth more than you sold it to him for

    Are you the type of person who would go on today tonight sort of program, because this would make
    a really good story for them...and shine more light onto what is now turning into scammers and
    fraudsters paradise...where the rules are tilted in their favor...it would make good TV having the cameras
    there for the opening of the return parcel...

    The reason I am asking so many questions is you have to think outside the square a bit here and without
    the full information it is hard to know how to play it...did for example, ebay say that they looked into the case
    and found the buyer to be fraudulent, or did ebay just rule in your favor

    If you have not already asked paypal not to refund the buyer yet..but to hold the funds in escrow until your have
    had a chance to seek legal advice...I would ask/tell them ASAP

    Hi Grant,
    When eBay ruled in my favour they said “there was to many red flags on the buyers side” that was the main reasoning. I believe the funds are in escrow until I “receive” the coin back. I’ll have to confirm with them. I have filed a dispute with my bank, but I have not reported anything to the financial ombudsmen yet.

    if any kind of parcel arrives, I will be filming it from the moment I walk into the post office.

    How the hell can they refund all the bloody money when the guy has that much gold, even if the coin is fuked its still worth no less than the gold value, did you mention that?
    Oh the horror the buyer is left with this useless piece of gold lol, thinks paypal, likely spot price is worth more than the coin sold for. Pricks have no idea.
    thats complete bullshit, Certainly not worth selling anything of value on ebay using paypal.
    I feel ya man

    but dont stop the fight, you need to contact ACCC at the very least, Iv had shit sorted prety fast by contacting them, Even contacting one of those news outlets to blast paypal policy.

    He paid less that spot FFS! As I wanted a quick sale. I’m never doing that again and certainly not sending overseas.

    Well that is at least a little bit of good news, If you have not already asked them to confirm this,
    when you do... also tell them that you do not authorise the release of "your" funds until the coin
    is in your hands.....and not on the buyer giving them a valid tracking number....because that is how
    he scammed bayareararecoins....he might work in an area that handles/uses international mail,
    and uses a current valid tracking number on someone else parcel...but it is not his parcel...and thus
    it looks like he has sent the coin...and of course goes somewhere else where they sign for it and
    it is automatically notified as confirmed delivery...

    I gave up fleebay about 4-5 years ,haven't heard too many good experiences in the last few years .
    Just been getting worse

    I just received shipping information from Fedex....
    What should be my plan of attack when the parcel arrives?
    1) of I’m home: film everything from the courier handing it to me, to ripening it and weighing it.

    I don’t have any other way of testing if it’s real gold etc

    Fedex has sent you a shipping manifest or tracking number? or
    is it the buyer that has sent you a tracking number

    First thing I would do is contact fedex....quickly explain your situation
    ask them to confirm if that particular tracking number is bound for Australia..

    The privacy wall can be a bitch....but you should be able to at least get a
    destination country from them

    then depending on how the conversation is going...ask if it is coming
    to your street and suburb...then ask them if they have a depot within
    a reasonable distance from you where it could be picked up from,
    because you work or whatever, then when you get there explain to
    them what you are doing and why

    The aim being is to document the parcels handing over and opening
    and verification...in one constant video, obviously as evidence
    You will need two people for this task I would think, one filming one opening,
    as I said before depending on where you live you may be able to get a
    film crew from today/tonight to accompany you and film if you are going
    down this path....which really would help bring ebay/paypal in line
    Start by going over the parcel for any proof of tampering, etc

    it would be easier to go to a depot to do this than wait around all day and
    then probably deal with a subcontract driver who probably doesnt want anything
    to do with it...and doesnt get paid for this kind of crap


    I think it is still more than likely that a parcel will not be received your end..
    We will see...shouldnt be long now

    The buyer has attached a tracking number to the PayPal case. It lists my correct suburb, but no further detail and that it hasn’t left his location yet.

    what do you mean by “The coin with the 'scratches' on the capsule they complained about is a fake“. As in the actual coin in the pic is a fake? It looks like my pic on the left except the fact that he scratched the capsule after receiving it. Other than the coin weighing 2 Troy ounces, is there any specific marking I should look for when opening the parcel?
    I have silver snakes, so I will take one for comparison.

    I wonder if al lthis could have been settled with a part refund of the value of the plastic capsule? wonder if that would have taken some of the wind out of his sails in regards to his complaint with ebay and paypal?
    Oh the plastic case is scratched, sure here is two bucks for a new one. wonder if that would have appeased both paypal and ebay?

    I tried this and more. His first case with eBay was for a late delivery even though it technically arrived on the ETA for arrival. I offered a partial refund of the shipping fee. For his next case “item not as described” I offered a new capsule sent to his address as a good will offer. He refused everything

    One of the biggest flaws with Ebay now, is You cant bloody well leave negative feedback to a buyer. so you cant warn other sellers.
    virtually a buyer can stuff you around as much as they like, even scam you and you still have to leave them positive feedback, the best you can do is not give them feedback at all. which is just crap
