But if you leave the country aren't you able to take your super anyway, at least as it currently stands
No, you can only take it if you are not a Citizen or a permanent resident and you have no intention of returning to oz.
On the grounds that you've "broken the law" - albeit some draconian statute to do with super that they pulled out their arses in order to confiscate your SMSF... That's the whole point i'm trying to make here... the gubbermint can make any law it wants to - even ones that are unconstitutional and violate your commonlaw rights. The thing is - are you going to lay down and submit to their tyranny or will you resist? Bad governments are good at making bad laws which can turn ordinary good citizens into "criminals" for choosing to resist these draconian laws....
so are you saying then that if you ARE a citizen but plan to emigrate that you just have to cop it sweet and give your super to the gubbermint?
Yes I know that Oz could ask for extradition on the ground that I've stolen my own money, but I just wonder whether a citizen of another country would be handed over because they've stolen their own money. I have no idea, just posing the question.
Would the other countries courts see it as reasonable to extradite you based on the fact it is your own money?
If you were in a fellow fascist police state - such as the US, UK, Europe or Canada, then probably yes - they would extradite you. If you were in a non-western country, then no - i dont think they would.
Well, that is the million dollar question. Surely someone must have already done this? Any case law out there?
lol - i guess there may just come a time then that one would have to denounce your citizenship then. It's a very sad thought, but that's what may be on the horizon should this country continue down the path of trampling the rights of individuals and their property rights
I'm not a citizen. That's why it's such a valid question, not that I have any ideas of doing such a thing, you understand! Of course, I would bend over and take it squarely up the posterior tunnel, like a good little compliant resident! LOL, thought I'd better edit that.
You would not be charged with stealing your own money per se but that you have breached numerous Superannuation laws relating to the preservation of your fund until retirement age. There would probably be further charges around failing your duty as a SMSF trustee etc etc.
