    I'm pretty sure I've seen that sort of "mistake" before - "oops, meant 10oz, sorry".

    Pretty sure there'll be disputes raised.

    Yes and it happens, no protection for seller, only the buyer. If buyer doesn't want to cancel, then you can't do anything more.

    There's nothing legally enforceable about e-bay at all. If the seller refuses to accept payment for an item, as a buyer, in all honesty, what are you going to do about it? Run off to the Police and say some ebay seller wont honor your bid? Puh-lease! Not going to happen. All you can do is complain to ebay which, if you are lucky, will result in a negative feedback score of 1. That's all there is too it.

    You would be quite wrong.
    Speaking in Australia (mainly NSW), it is fraud.

    I believe section 527A (old section) 192E (new section) of the Crimes Act Crimes Amendment (Fraud, Identity and Forgery Offences) Act 2009 is one offence you could be charged with.

    Let's say that someone wins the bid and the buyer pays them the money. The seller does not like the result and keeps the money and either breaks contact or even worse tries to extort further money from the buyer.

    As well as the initial fraud being section 192E of the act you also have the further offence of register g to gain more money.

    192E states by any deception, dishonesty obtaining another's property, obtaining any financial advantage or causing any financial disadvantage.

    Now I am only talking about the plain simple examples here and not ones where the buyer returns the money or an agreement is made between buyer/seller.

    I know of many people who have been charged with these offences and have lost in court.

    EBay help police quite easily these days as if I am not mistaken to be a seller on eBay you need a papal account. Do in the end there is enough paper trail to lead police to the seller.

    Just my 2 cents as I am sick of the sellers that think they can get away with not honoring saled.

    Given this there are steps the buyer does need to do first like as mentioned report it to EBay/allow time for delivery/leave negative feedback etc.

    Hope this clears a few things up.

    @ GhostEagle. If I was that seller, I wouldnt proceed with the sale. If the buyer paid me, I would refund his money with an explanation. No money kept, no issue.

    The relevant Act you quote might be all well and good but if the buyer is in say WA and the seller happens to be in NSW, really, do you think NSW police would try to gain a sworn statement from a complainant in WA and proceed with charges for an amount of $431 ?!

    It becomes even more absurd if the complainant happens to be live outside Australia. Like I say if the seller simply refunds to the $431 then there's no issue, matter closed.

    I completely agree with you Matthew.

    Like I said the Act I stated is NSW. And actually other states can follow up persaunt of NSW law. But like you did cost benefits would over weight the incident.

    But like you said if it is overseas well the buyer is screwed.

    As you mentioned, if the buyer does return the money well your right all is good. I was just going along the worst case situation.

    This person basically wants to swap the original sellers debt (mistake), to governments fiat debt.

    No way lol, you know this deal would never be honored so they'd gain 600 dollars doing nothing and you'd lose 1k :|

    Makes me wonder how listings like that are valid on eBay

    I dont think that he will find someone to buy it, even tho its $1k - and he provided the paper trail , so that the new buyer can check and verify heheh

    had he made it $600 than maybe,

    Definately not worth it.
